V/Line Inform - Terms & ConditionsTo use our V/Line Inform service, you need to acknowledge and agree to comply with the following Terms and Conditions.  Use of the service constitutes acceptance of these Terms and Conditions.

General conditions
The V/Line Inform service is provided by V/Line Pty Ltd (V/Line).

V/Line Inform messages via SMS are available to all Australian mobile networks capable of sending/receiving SMS messages. V/Line Inform messages via email are available to any person with a valid email address and with access to an Internet connection.

V/Line may alter these Terms and Conditions from time to time and it is the user’s responsibility to monitor changes to the Terms and Conditions (the amended Terms and Conditions will be accessible on the V/Line Inform website). All changes are effective from the date of posting on the V/Line website. Any updated version of the Terms and Conditions will immediately supersede any prior version and continued use of the V/Line Inform service constitutes acceptance of the updated Terms and Conditions.

In compiling the information sent by V/Line’s V/Line Inform service, V/Line (and any person or entity associated with the V/Line Inform service) aims to ensure that the information is correct and current at the time of transmission but takes no responsibility for any error, omission or defect therein.

To the extent permitted by law, V/Line and its related companies and the employees, officers, agents and contractors of V/Line and its related companies exclude all liability for any loss or damage (including, without limitation, direct, indirect or consequential loss or damage, loss of profit, or loss of business opportunity) arising from the use of, reliance on, or failure to receive, the information provided by the V/Line Inform service or arising from any failure of the V/Line Inform service to provide information, whether or not caused by any negligent act or omission.

Nothing in these Terms and Conditions excludes any term implied by legislation which cannot be excluded. Any such term will apply in accordance with the legislation, however where permissible by law, V/Line’s liability (or the liability of any other person or entity) for breach of any such term will be limited to (at the election of the person or entity liable) the supplying of the V/Line Inform service again or the payment of the cost of having the service supplied again.

V/Line relies solely on the input of the user as the basis on which appropriate SMS and email updates will be identified and sent. V/Line does not independently verify the correctness or accuracy of input of the user.

V/Line shall not be responsible for any incorrect or inaccurate information, whether caused by V/Line Inform users or by any of the equipment or programming associated with or utilised with the V/Line Inform service, or for any technical or human error which may occur in connection with the operation or administration of the V/Line Inform service or any such equipment or programming (including, without limitation, where the V/Line Inform service is not provided to a user for whatever reason).

To the extent permitted by law, all representations, conditions or warranties, whether based in statute, common law or otherwise are excluded by V/Line and any other person or entity associated with the V/Line Inform service.

These Terms and Conditions will be governed by and construed in accordance with the laws of Victoria, Australia, and the user agrees to submit to the exclusive jurisdiction of the courts of the State of Victoria. In the event that any provision of these Terms and Conditions is held to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms and Conditions which shall continue to have full force and effect.

ChargesAll SMS or email messages sent to users’ mobile phones or email addresses as part of the V/Line Inform service are free.

Users should not reply to any messages, as such replies will not be received by V/Line. If a user does reply to any message, such reply may incur charges by the user’s telecommunications and/or Internet service providers, and V/Line will not be responsible for such charges.

DeliveryOnly users who have completed the official registration process will qualify to receive updates by SMS and/or email. This registration process is found here.

The correct and successful completion of all fields within the registration page will officially register the user to receive SMS and/or email updates as part of the V/Line Inform service.

By registering to use the V/Line Inform service, users consent to receiving messages from V/Line via SMS or email, and agree that such messages may not contain any functional unsubscribe facility.

SMS and email are not guaranteed delivery communication tools. V/Line does not warrant or represent that all cancellations and delays will be notified to users who are registered for the V/Line Inform service.

V/Line (and any other person or entity associated with providing the V/Line Inform service) does not accept responsibility for any SMS or email messages not received by the user, or for any delay in the receipt or delivery of any SMS or email message. V/Line (and any other person or entity associated with providing the V/Line Inform service) assumes no responsibility for any user error or omission, interruption, deletion, defect, delay in operation or transmission, communications line/network failure, computer viruses, bugs, unauthorised intervention, fraud, technical failures, or theft, destruction or unauthorised access to, or alteration of, any information provided, in connection with the V/Line Inform service.

All information is subject to change. While V/Line endeavours to provide up-to-date information on services operated, it takes no responsibility for cancellations/delays/other incidents, which may occur.

Intellectual property
All intellectual property rights in relation to the V/Line Inform service (including, without limitation, in relation to timetable data, website content and the contents of SMS and email messages) are owned by V/Line or its licensors and (subject to the following sentence) users are not permitted to exploit those rights in any manner. Users may only use the V/Line Inform service for their own private, personal purposes (to inform them about disruptions to V/Line services) and not for any business purposes.

Privacy
V/Line takes privacy seriously and V/Line’s collection and use of any personal information in connection with the V/Line Inform service is subject to our privacy policy.
